User Terms for the App

These user terms ("App Terms") apply between Bulder, a part of Sparebanken Vest ("Bulder"), and you as a user of Bulder’s mobile application ("the App").

1. Bulder of Sparebanken Vest

Bulder is a part of Sparebanken Vest. Any agreements you make with Bulder are therefore agreements with Sparebanken Vest, located at Jonsvollsgaten 2, 5011 Bergen, Norway, org. no. 832 554 332.

Bulder is a self-service mobile bank. The app is your primary channel for using Bulder's products and services and for accessing your account details with Bulder.

2. Rights

Bulder holds all rights to the App and its content, including rights to the app’s components such as underlying code and software, as well as content in the app like text, graphics, symbols, and logos.

You may not copy or use any components of the App without prior written permission from Bulder. The content in the App can only be used for personal use. For any other use, you must obtain written permission from Bulder.

Components in the App that Bulder has a usage right to, and that belong to other rights holders, may not be used without permission from the relevant rights holder.

3. Usage Rights

By accepting these App Terms, you receive a personal right to use the App. The App cannot be used by anyone other than you, as described in point 6. The app is only to be used for using Bulder’s services as mentioned in point 1, and in accordance with these App Terms.

You cannot use the App in violation of Bulder's rights to the App and its content as outlined in point 2.

If you wish to use the App on multiple devices, you must install the App and accept the App Terms for each device. When installing the App on a new device, you will receive a notification on all old devices.

4. Privacy

To use the App, Bulder needs to receive, use, and store some of your personal information. Most of the personal data will be provided when you register as a customer with Bulder and start using the App. Bulder’s use of personal information is described further in our privacy policy ("Privacy Policy"), which you can find at Bulder Privacy Policy.

The Privacy Policy is part of these App Terms.

5. Terms for Using Products and Services in Bulder

5.1 General

Your use of Bulder’s products depends on a separate agreement for each product. Before using each product, you will be asked to review and accept the product’s terms and conditions in the App. If you violate the product’s terms and conditions, Bulder will revoke your access to that product in the App.

If there is a conflict between these App Terms and the terms related to a product at Bulder, the product-specific terms will take precedence.

You will always find the terms for the products you have used from Bulder under "Settings" in the App. Some products and services are integrated into the App, and the terms for such integrated products and services are mentioned in points 5.2 and 5.3 below.

5.2 Future Overview

The "Future Overview" service in the App gives you an expected overview of your future finances. This service uses collected transaction data from all your accounts at Bulder.

5.3 Invoice Scanner

The "Invoice Scanner" service in the App automatically fills in payment details required to pay an invoice in the App, based on a picture of the invoice taken with your mobile camera. To use the Invoice Scanner, Bulder will need access to your camera and photo library.

The photo you take with your camera will be sent to Bulder for scanning. During scanning, Bulder will identify the payment details in the photo and return these details to the App. You can choose to use the suggested payment details or overwrite them manually. You are responsible for checking that the automatically filled-in payment details are complete and correct. You must enter the amount yourself. You confirm and approve the payment details with fingerprint or facial recognition.

The photo you take will be temporarily stored on your device and deleted immediately after the payment details are filled.

All information stored and sent in connection with the "Invoice Scanner" service is anonymized. No personal data that may appear in the image is stored. However, it is recommended that you avoid capturing any part of the invoice containing personal information.

The software for the "Invoice scanner" is developed by Payr AS, registered in Norway with organization number 916 840 535. Bulder has been given the rights to use the software

5.4 Subscription Overview and Subscription Cancellation

The "Subscription Overview" service in the App automatically identifies your ongoing subscriptions, memberships, and other products based on payments made from all your accounts at Bulder. Bulder cannot guarantee that the subscription overview is complete.

If you wish, Bulder can also cancel your identified subscriptions on your behalf. Subscription cancellation requires you to sign a power of attorney that grants Bulder and its subcontractors the right to access terms and conditions for the subscription and cancel it. You will find the power of attorney by selecting "Cancel subscription" in the App.

If Bulder uses a subcontractor to perform the cancellation, the subcontractor will have access to necessary personal data to complete the cancellation. The processing of personal data is regulated in the data processor agreement between Bulder and the subcontractor.

If Bulder or its subcontractor cannot reach the subscription provider or if the cancellation cannot be completed for other reasons, Bulder or the subcontractor may pause or cancel the subscription cancellation before it is completed. You can track the status of the subscription cancellation in the App.

The software behind the "Subscription Overview" service is developed by Subaio ApS, registered in Denmark with CVR number 37766585. Bulder has been granted usage rights to the software.

6. Security

Your usage rights to the App are strictly personal and linked to your registered devices. You must ensure that no third party, including family members, has access to the App through your usage rights and devices. You must take all reasonable precautions to protect your personal code or other security information.

We recommend that you do not use the App on a "jailbroken" (iOS) or "rooted" (Android) device, as these devices may pose a security risk due to a lack of security restrictions in the operating system.

If your mobile phone or another device is lost, stolen, or if you suspect unauthorized use of your usage rights, you must report the matter to Bulder immediately. Bulder will then block your access to the App until the situation is resolved to Bulder's satisfaction.

You must also follow the security advice provided by Bulder.

7. Blocking and Revocation of Usage Rights

7.1 Blocking Usage Rights

If Bulder reasonably believes that you are using the App in violation of the App Terms or Norwegian law, or that your use could result in Bulder violating Norwegian law, Bulder has the right to block your usage rights until the matter is resolved. Bulder can also block your access after notifying you as described in section 6 above.

7.2 Revocation of Usage Rights

Bulder can revoke your usage rights to the App with immediate effect if you breach or attempt to breach the App Terms or Norwegian law, or if you provide Bulder with incorrect information when installing or using the App.

In such cases, Bulder is under no obligation to notify you before revoking your usage rights.

7.3 Uninstallation

After your usage rights have been revoked or expired, you must uninstall the App from all devices where it is installed.

8. Responsibility

The App and its content are continuously developed and updated as needed and may be changed at any time by Bulder. Bulder makes no guarantees that the App will always contain complete or up-to-date information.

Bulder is not responsible for indirect losses resulting from errors or defects in the App.

Bulder is also not responsible for links from the App to external applications or websites, or the content on such external applications or websites.

9. Duration

Your usage rights to the App remain valid as long as you are a customer with Bulder and have accepted these App Terms, unless your usage rights are blocked or revoked under section 7.

As long as you remain a customer and your usage rights to the app is not blocked or revoked, the App Terms still applies even if you uninstall the app from your phone or other devices.

10. Changes

Bulder may change the App Terms without prior notice to you. When the App Terms are updated, the changes will be highlighted, and you will be asked to accept the updated terms.

Changes to the terms for your products at Bulder are regulated by the terms for the specific product.

11. Contact Information and Communication

If your contact information changes, you must promptly update it in the App. Bulder will periodically check your registered contact information.

You will receive messages from Bulder containing personal data via secure email through Bulder’s current secure email solution.

12. Dispute Resolution

These App Terms are governed by Norwegian law. The court of Bergen is the agreed venue.

If a dispute arises between you and Bulder regarding the App Terms, you can bring the matter to the Financial Services Complaints Board when the board is competent and you have a legitimate interest in obtaining its opinion. Complaints to the Financial Services Complaints Board should be directed through their complaint form at www.finkn.no or to Financial Services Complaints Board, Postboks 53, Skøyen, 0212 Oslo.
